TERMS AND CONDITIONS OF GOLDENHUB s.r.o.

  1. INTRODUCTORY PROVISIONS

1.1. These Terms and Conditions govern the mutual rights and obligations between the Seller and the Buyer arising in connection with the conclusion of a purchase contract through the online store.

1.2. The Seller is:

(hereinafter referred to as the “Seller”)

1.3. The Buyer is a natural or legal person who concludes a purchase contract through the Seller’s online store (hereinafter referred to as the “Buyer”).

1.4. These Terms and Conditions are issued in accordance with Act No. 89/2012 Coll., the Civil Code of the Czech Republic, and relevant legal regulations of the Czech Republic and the European Union.

  1. CONCLUSION OF THE PURCHASE CONTRACT

2.1. All presentations of goods placed on the web interface of the e-shop www.goldenhub.cz are for informational purposes only and the Seller is not obliged to conclude a purchase contract regarding such goods.

2.2. An order placed by the Buyer through the online store constitutes a proposal to conclude a purchase contract.

2.3. The purchase contract is concluded at the moment the Seller confirms the order by e-mail.

2.4. The Seller reserves the right to reject an order in the event of a technical error, unavailability of goods, or an obviously incorrect price.

  1. PRICE AND PAYMENT TERMS

3.1. All prices of goods are stated including VAT in accordance with applicable legal regulations.

3.2. The Buyer may pay the purchase price and any delivery costs using the following methods:

a) cashless payment by card via the GlobalPayments payment gateway
b) Apple Pay or Google Pay
c) bank transfer to the Seller’s bank account
d) cash on delivery, if available for the specific order

3.3. In the case of payment by bank transfer, the Buyer will receive the payment details after completing the order.

3.4. The goods are dispatched only after the full purchase price has been credited to the Seller’s account, unless otherwise agreed.

  1. DELIVERY TERMS

4.1. Delivery is carried out by transport companies selected by the Buyer according to the current offer in the e-shop.

4.2. The delivery price is determined by the tariffs of the respective carriers.

4.3. The delivery time usually ranges from 3 to 10 working days, unless otherwise stated for a specific product.

4.4. In the case of orders exceeding 20,000 CZK or 800 EUR and if cash on delivery is selected, shipment is carried out exclusively by DHL, which provides insurance coverage for shipments above this value.

4.5. Ownership of the goods passes to the Buyer upon full payment and receipt of the goods.

  1. WITHDRAWAL FROM THE CONTRACT

5.1. The Buyer has the right to withdraw from the purchase contract without giving any reason within 14 days from the date of receipt of the goods.

5.2. To withdraw from the contract, the Buyer may send a notice by e-mail or in writing to the Seller’s address.

5.3. The returned goods must be unused, undamaged, and in their original packaging.

5.4. The costs of returning the goods shall be borne by the Buyer.

5.5. Withdrawal from the contract is not possible for custom-made goods and for earrings for hygienic reasons.

  1. RIGHTS ARISING FROM DEFECTIVE PERFORMANCE AND WARRANTY

6.1. The Seller is responsible to the Buyer that the goods are free from defects upon receipt.

6.2. A statutory warranty period of 24 months is provided for the goods.

6.3. Claims may be submitted by the Buyer in writing or by e-mail to the Seller.

6.4. Complaints will be handled no later than 30 days from the date of submission.

  1. OUT-OF-COURT DISPUTE RESOLUTION

7.1. The Czech Trade Inspection Authority, with registered office at Gorazdova 1969/24, 120 00 Prague 2, website: www.coi.cz, is competent for out-of-court resolution of consumer disputes.

7.2. The Buyer may also use the online dispute resolution platform at http://ec.europa.eu/consumers/odr.

  1. PERSONAL DATA PROTECTION

8.1. The Seller processes personal data of Buyers in accordance with GDPR and applicable legal regulations.

8.2. Detailed information on the processing of personal data is available on the Seller’s website in the Personal Data Protection section.

  1. FINAL PROVISIONS

9.1. These Terms and Conditions are valid from the date of their publication on the website www.goldenhub.cz.

9.2. Legal relations not governed by these Terms and Conditions shall be governed by the laws of the Czech Republic.

9.3. All disputes shall be resolved before the competent courts of the Czech Republic.
